My company pays me per diem, .10 of my .44 cpm is non taxed. I've done the math, they are doing it correctly.
With the miles I do weekly, I'm getting shorted.
I'm OTR, company driver, and home maybe 5 days a month to every other month.
Can I claim the missing per diem when I do my taxes or do I lose what I'm not getting? Would I be better off trying to opt out and claim it all myself?

You would definitely be better off option out of Per Diem if you can. It is to the companies advantage as they don't have to pay any matching SSI and Medicate on what they pay you in Per Diem.

As far as the deduction question that you need to discuss with your accountant when you do your taxes. I'm not positive of the right answer for that. I would guess that the amount of the deduction that your allowed to take minus the amount they are paying you towards it should be deductible, but I'm not a tax expert so that's just my best guess. If you do get a professional answer please come back and share it with us.

Just an update to this post. I am also a tax preparer and with the new tax laws the only way for a company driver do get the per diem deduction in years 2018 through 2026 if for their company to hold it out. The place where they have deducted it in past years has been eliminated.
